Incretin Mimetic Drug Lawsuits Consolidated in Federal Court

On August 28, 2013, it was announced that litigation involving incretin mimetic drugs Byetta, Victoza, Januvia, and Janumet are being consolidated into multi-district litigation in California federal court.  Usually lawsuits against different companies, as is in this case, are not consolidated into one MDL.  In this case however, many of the plaintiffs bringing the lawsuits have taken more than one of these drugs, therefore consolidation made sense.  In addition, all of these drugs are used to treat type 2 diabetes, all belong to the same class, and all are alleged to cause pancreatitis and pancreatic cancer.  This creates many common issues for the courts, and cases can be dealt with much more efficiently if evidence is gathered at one time instead of separately for each drug.  Outcomes for both the plaintiffs and defendants will be more consistent as well.

Unlike with a class action lawsuit however, in an MDL, each individual plaintiff will be granted an individual damage award.  This allows for efficiency in the process, but still for individualized treatment of each plaintiff.

The cases in the MDL are known as In re: Incretin Based Therapies Products Liability Litigation, MDL No. 2452.  The cases are in the United States District Court for the Southern District of California, supervised by Judge Anthony Battaglia.
